US House Committee on Oversight and Government Reform Chairman James Comer has opened an inquiry into Delaware’s initiative to establish a corporate form called an Artificial Intelligence Company (AIC). According to the Committee’s release, the proposal would allow an AI agent to manage the company’s day-to-day operations and would give the person or entity behind it protection from liability for potential harms to consumers, the public and business partners attributed to the controlling AI. The measure has not been enacted: the release says a subcommittee of the Delaware Artificial Intelligence Commission is working toward a draft regulatory framework for a sandbox involving agentic AI in corporate governance.

Comer requested documents and information from Governor Matt Meyer concerning risks assessed by the state and the forces driving Delaware and other states toward similar proposals. He also contends that a state commission report dated December 22, 2025 did not mention assessments of safety and harms or outside consultations with independent experts, and alleges insufficient transparency about contributions from AI companies and their representatives. These are concerns stated in the congressional release, not established findings: the underlying letter, state report and draft framework or legislation were not reviewed directly. The House Committee says the inquiry could inform possible federal legislation intended to limit similar state AI regulatory initiatives.
