Italy: privacy opinion backs access to some health records at 14

The opinion concerns independent access to records of care minors can receive without parental involvement. Final adoption and commencement of the decree remain unverified.

Federprivacy, in its article “Fascicolo sanitario, i ragazzi che hanno compiuto 14 anni potranno accedere autonomamente ai propri dati sanitari”, published on 3 November 2026, reports that Italy’s data protection authority issued a favourable opinion on a Health Ministry decree. The measure would allow minors aged 14 and over to consult their electronic health record (FSE) using their own digital identity, without parental mediation, solely for data and documents concerning care they can receive independently, such as certain services at family counselling clinics. These records would not be visible through the FSE or health data ecosystem services to parents, other holders of parental responsibility or any authorised representatives.

According to Federprivacy, the decree would also regulate access by general practitioners and primary care paediatricians working within specified local healthcare organisations, including territorial functional groups, community health centres and community hospitals. Only those professionals would gain access to the records of patients receiving care at those facilities, in addition to their own patients’ records. The other provisions described would restrict processing of information drawn from records hidden from access to services dedicated to the patient, and would expressly refer to the national delegation system for the FSE as well.

Federprivacy attributes the report to the Italian data protection authority and cites measure No. 750 of 7 October 2026. Neither the decree nor the opinion was consulted directly: the account supports reporting the favourable opinion but does not establish whether the decree has been finally adopted or entered into force. Whether the changes are operational therefore remains to be verified.
